Please read these Terms of Use (“Terms”) carefully before using this website. These Terms govern your access to and use of the website located at statewideofhoughton.com (the “Site”), operated by Statewide of Houghton (“Statewide of Houghton,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. About This Site

Statewide of Houghton is a real estate brokerage serving Michigan’s Upper Peninsula. The Site provides property listings, market information, community resources, and general information about our services. The Site is intended to help prospective buyers, sellers, and the public learn about real estate in the region and connect with our agents.

2. Eligibility and Acceptable Use

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Site in any way that violates applicable federal, state, or local law or regulation.

3. Property Listings and MLS/IDX Information

Property listing data displayed on the Site comes in part from the Internet Data Exchange (IDX) program of the Upper Peninsula Association of REALTORS® (UPAR) Multiple Listing Service. IDX information is provided exclusively for consumers’ personal, non-commercial use and may not be used for any purpose other than to identify prospective properties consumers may be interested in purchasing.

Listing data is deemed reliable but is not guaranteed accurate by the MLS or by Statewide of Houghton. Property availability, pricing, descriptions, square footage, lot dimensions, taxes, school information, and other details are subject to change without notice and may contain errors or omissions. Listings may be sold, withdrawn, or under contract at any time. You should independently verify all information that is important to your buying or selling decision, and we encourage you to confirm details directly with a licensed agent before relying on them.

Listings marketed by brokerages other than Statewide of Houghton are identified in accordance with MLS rules and remain the property of the listing brokerage.

4. No Professional Relationship or Advice

Using the Site, submitting a contact form, or browsing listings does not create an agency, brokerage, fiduciary, or client relationship between you and Statewide of Houghton. A representation relationship is established only through a signed written agreement with our brokerage.

Content on the Site is provided for general informational purposes only. It is not legal, financial, tax, appraisal, inspection, or investment advice, and it should not be relied upon as a substitute for guidance from a qualified professional. Real estate transactions carry financial and legal consequences; please consult the appropriate licensed professionals before making decisions.

5. Fair Housing

Statewide of Houghton supports and complies with the Federal Fair Housing Act and the Michigan Elliott-Larsen Civil Rights Act. 6. Intellectual Property

Except for MLS/IDX listing data and other third-party content, the Site and its contents — including text, graphics, logos, photographs, page layouts, and design — are the property of Statewide of Houghton or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may view and print pages from the Site for your own personal, non-commercial use. You may not reproduce, distribute, modify, republish, frame, or create derivative works from any portion of the Site without our prior written permission. The Statewide of Houghton name and logo may not be used without authorization.

7. User Submissions

If you submit information through a contact form, request, review, or other communication on the Site, you are responsible for the accuracy of that information and confirm that you have the right to provide it. Do not submit content that is false, unlawful, defamatory, infringing, or that contains another person’s confidential information without their consent.

By submitting content, you grant Statewide of Houghton a non-exclusive, royalty-free license to use that content as reasonably necessary to respond to your inquiry and to operate the Site. We are not obligated to publish, retain, or act on any submission.

9. Copyright Complaints

We will review and respond to valid notices and remove infringing material where appropriate.

10. Disclaimer of Warranties

To the fullest extent permitted by law, Statewide of Houghton and its owners, agents, and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of — or inability to use — the Site, even if we have been advised of the possibility of such damages. Your sole remedy for dissatisfaction with the Site is to stop using it.

12. Indemnification

You agree to indemnify and hold harmless Statewide of Houghton and its owners, agents, and employees from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.

15. Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Houghton County, Michigan, and you consent to the jurisdiction of those courts.

16. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Statewide of Houghton regarding your use of the Site.
